I write to you because you may be the only person who has positive advise! We bought a piece of land in dept 40. The small chalet was of poor quality so we search for a Maître d’oeuvre who then sort out the builders etc!! This has been an on going nightmare, over one year, the plans put in, this part went OK. The chalet demolished including the terrace it stood on, behind the terrace is a sand-dune (might I add on the move). Now the builders are Bankrupt! we have no build, we do have a huge pile of sand, no terrace and at least 50% deposit paid now to our loss. It also appears that we did not have the correct insurance cover so no legal aid for judge & jury. We cannot finish the build because we do not have enough money in the pot. Is there anyone legal in France that we could talk to. We have had an Advocate to proceed with the dossier on the builders, & we would like to proceed with legal action on the Maître d’oeuvre but it is down to costs, any advise please

I am sorry to hear your tale. Builders are a high risk service anywhere, make sure you claim is clearly in the hands of the liquidator, although I doubt there will be anything left once their charges are paid.
The Mâitre d’ouvre should carry insurance and, depending on the agreement you signed with them, you shouml be able to get compensation. They belong to a ‘professional’ society so find this out and make an application to them if the MO does not satisfy you.
Unfortunately there is no legal aid or assistance, that I am aware of, you can apply for and generally you will have to ind out an do everything yourself, this will involve many piles of paperwork and a lot of different departments, none of which seems to communicate with any another.
You are already talking to a local avocat, compared to most countries they are not expensive and they will specialise, so you should already be in the right area of expertise, but they still cost money (about 200 euro per hour) – I will ask my readers if they have any advise or information they can share
